MARK TICER: An ERISA plan is a benefit or a set of benefits offered by an employer that’s governed by the rules of the employer.

The strengths of our firm is that we’re hands-on. We want our clients to be educated and understand the process of which they’re going through.

They need to know early on that we’re need to get as much information as we can. It’s what the call the administrative record so the court can consider that if we’re unsuccessful on the administrative level.

It is very difficult to start putting in new evidence in a court case that’s not in the administrative record.

Our firm has a great deal experience with ERISA claims. We know what to do, particularly about information gathering, what terms you must comply with, what are the deadlines, what documents you need to request and review, putting information into a form that can be understood and is persuasive.

The failure to comply with any of the aforementioned may bar our client’s claim, which would be a tragedy, purely on procedural grounds, rather than the merits of the claim.
