Texas Breach of Contract Attorney
Insurance contracts and Texas law require prompt payment of insurance claims. In fact, Texas law provides penalties for a claim improperly denied or delayed. At our Dallas law firm, we handle insurance claims payment disputes. Our lawyer, Mark A. Ticer, has been helping clients with such matters since our firm was founded in 1990.
Slow payment of claims as well as wrongful denial of claims is a form of insurance bad faith and is a violation of the Texas prompt payment of claims statute. The law requires insurers to acknowledge receipt of the claim within 15 days and to provide notice of acceptance or rejection of the claim within 15 days of receipt of all needed documents. Furthermore, it must pay an accepted claim within five days of sending the notice of acceptance. If an insurance carrier does not meet these deadlines, it is liable for penalties, interest on the claim amount, attorneys fees and court costs.
Details About the Prompt Payment of Claims Statute
This statute applies to many first party claims under homeowners, commercial, life, PIP (Personal Injury Protection) and disability insurance policies (now ERISA). The statutory deadlines are very clear. Insurance companies have little ability to avoid these requirements. If an insurance company fails to pay on a claim promptly, it may be guilty of insurance bad faith and liable for the penalties provided by law.
